The Fiscal Delegation Law and its potential impact on gambling in Italy

The Fiscal Delegation law so called “Delega Fiscale” has been finally voted on the 4th of March by the Italian Parliament and published today in the Official Journal. It is aimed to empower the Government to legislate on several matters, gambling regulation and taxation among others under art. 14 of the law.
The general scope of article 14 of the Fiscal Delegation law is to reorganize and harmonize public gambling regulation and taxation, it being understood the concession model of transferring public powers from the State which has the statutory reserve on gambling will remain unchanged, for reasons of public order protection, public health, local and State interests balancing, fraud prevention such as anti-money-laundering and State revenues regularity.
Article 14 covers all area of gambling. Main subjects are undertaking of concrete actions regarding AWP/VLT rational distribution in public premises within the territory and the revision of gambling products taxation in order to review and balance the different tax regimes of the gambling products.
It also calls the Government for action on the points of sales and AWP/VLT licensed management and certification , on the reform of horse betting through a national horse league institution and on the revision of the current gambling advertising regulation. Specifically as regards gambling advertising, it urges the Government on the need to revise the advertising regulation for a better protection of minors.
Last but not least, it calls for institution and coverage of a fund for gambling addiction.
In any case, any regulatory change will only be possible via decrees issued within twelve months of the Fiscal Delegation Law enforcement.
