Italian residents are currently not allowed to gamble on internet websites – except on those holding a concession from the state regulator, the AAMS. The Italian Chamber of Deputies is currently examining if a remote gambling decree will extend those concessions to operators licensed by other EEA Member States.
The European Commission has issued formal comments on Italy’s draft remote gambling decree.
The Italian government notified the European Commission, on 28 December, of its draft decree which sets criteria that operators must meet in order to offer online gambling services in Italy.
A recent Italian Supreme Court case, concerning the prosecution of an individual for offering gambling services without fulfilling the necessary licensing provisions, has upheld that Italy’s regulatory framework was incompatible with EU law and the Placanica ruling.
